Terms of Service

Welcome to WonderYarn. These Terms of Service ("Terms") govern your access to and use of the WonderYarn website, products, and services (collectively, the "Service").

By accessing or using WonderYarn, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and Family Use

You may use WonderYarn only if:

  • you are at least 18 years old, or
  • you are the parent or legal guardian of a child and are using the Service on the child's behalf

WonderYarn is intended to be used by parents, guardians, and families. If you use WonderYarn for a child, you are responsible for that child's use of the Service and for the information submitted through the Service.

2. The Service

WonderYarn provides a service that helps families create personalized stories for kids based on information such as a child's first name, age, gender selection, and interests.

WonderYarn may change, improve, suspend, or discontinue all or part of the Service at any time.

3. Accounts

Some features may require an account.

If you create an account, you agree to:

  • provide accurate and complete information
  • keep your login credentials secure
  • promptly update your information if it changes
  • accept responsibility for activity that occurs under your account

We may suspend or terminate an account if we believe these Terms have been violated or the Service is being misused.

4. Story Inputs and Public Story Links

When you use WonderYarn, you may provide information such as a child's first name, age, gender selection, and interests to personalize a story.

You agree not to submit:

  • sensitive personal information
  • unlawful, harmful, abusive, or infringing content
  • information you do not have the right to provide

Generated stories may be accessible by URL. Anyone with the link may be able to view the story. You are responsible for the information you choose to include in story inputs, and you should avoid including sensitive or private information.

5. Acceptable Use

You agree not to:

  • violate any law or regulation
  • infringe or violate the rights of others
  • interfere with or disrupt the Service
  • attempt to gain unauthorized access to the Service, accounts, or systems
  • introduce malware, malicious code, or harmful content
  • use automated means to scrape, harvest, or copy the Service without our written permission
  • use WonderYarn to create content that is unlawful, abusive, deceptive, or harmful
  • misrepresent your identity or affiliation

6. AI-Generated Content

WonderYarn uses automated systems to help generate story content.

You understand and agree that:

  • story outputs are generated automatically
  • outputs may not always be accurate, complete, or appropriate for every child or situation
  • parents and guardians should review stories before relying on them

WonderYarn does not guarantee that generated content will always be error-free, suitable for a particular educational purpose, or appropriate for every age or audience.

7. User Content

As between you and WonderYarn, you retain ownership of the information and content you submit to the Service ("User Content").

You grant WonderYarn a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, adapt, display, and process User Content solely as needed to operate, improve, secure, and provide the Service.

You represent that you have the rights needed to submit User Content and grant this license.

8. WonderYarn Content and Intellectual Property

The Service, including its software, design, branding, text, graphics, features, and other content provided by WonderYarn, is owned by WonderYarn or its licensors and is protected by intellectual property and other applicable laws.

Except as expressly allowed in these Terms, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use WonderYarn content without our prior written permission.

9. Feedback

If you send us feedback, ideas, or suggestions about WonderYarn, you agree that we may use them without restriction or compensation to you.

10. Privacy

Your use of WonderYarn is also governed by our Privacy Policy and our Children's Privacy & Safety page. By using the Service, you acknowledge that we may collect and use information as described in those documents.

11. Third-Party Services

WonderYarn may rely on third-party services to operate parts of the Service, including services for hosting, analytics, fonts, authentication, communications, and similar functionality.

We are not responsible for third-party services, websites, or content that we do not own or control. Your use of third-party services may be subject to their own terms and policies.

12. Paid Features

WonderYarn does not currently provide a live paid subscription flow through the Service.

If we introduce paid features, subscriptions, or other paid services in the future, additional pricing, billing, renewal, cancellation, and refund terms may apply and will be disclosed at that time.

13. Termination

You may stop using WonderYarn at any time.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe:

  • you violated these Terms
  • your use creates risk for WonderYarn, other users, or third parties
  • suspension or termination is necessary for legal, security, or operational reasons

Sections that by their nature should survive termination will survive, including sections relating to intellectual property, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution.

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WONDERYARN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee that:

  • the Service will always be available, uninterrupted, or error-free
  • generated stories will always be accurate, complete, or appropriate
  • the Service will be secure or free from harmful components
  • defects will always be corrected

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WONDERYARN AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF WONDERYARN FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

  • ONE HUNDRED U.S. DOLLARS (US $100), OR
  • THE AMOUNT YOU PAID TO WONDERYARN, IF ANY, IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless WonderYarn and its affiliates, owners, officers, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, losses, costs, expenses, and fees, including reasonable attorneys' fees, arising out of or related to:

  • your use of the Service
  • your User Content
  • your violation of these Terms
  • your violation of any law or the rights of another person

17. Changes to the Service or These Terms

We may update the Service or these Terms from time to time.

If we update these Terms, we will post the updated version and update the "Last updated" date above. By continuing to use the Service after updated Terms become effective, you agree to the revised Terms.

18. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles.

19. Dispute Resolution and Venue

You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be brought exclusively in the state courts located in St. Lucie County, Florida, or, if federal jurisdiction exists, the federal courts with jurisdiction over that area, and you consent to the personal jurisdiction of those courts.

Before filing a claim, both sides agree to try to resolve the dispute informally by contacting the other side first.

20. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with the Privacy Policy and any other terms expressly incorporated by reference, form the entire agreement between you and WonderYarn regarding the Service and supersede any prior agreements relating to the same subject matter.
